By submitting a commission request, completing payment, or otherwise using my services, you acknowledge that you have read, understood, and agreed to these Terms of Service.1. Eligibility and Product SafetyMy products are intended for collectors and display purposes only. They are not toys and are not suitable for children.Due to the presence of small parts and handmade construction elements, my products may present choking, ingestion, or other safety hazards. It is your responsibility to keep all products out of reach of children and to use them appropriately.I disclaim all liability for accidents, injuries, damages, or losses resulting from improper use, handling, storage, or supervision of my products.2. Right to Refuse ServiceI reserve the right to refuse, decline, cancel, or discontinue any commission request at my sole discretion and without obligation to provide justification.Reasons may include, but are not limited to, workload limitations, legal concerns, ethical concerns, inappropriate conduct, communication issues, or any other circumstance I consider incompatible with my business.3. Commission Requests and ReferencesYou are responsible for providing complete, accurate, and clear references when submitting your commission form.All important design elements, preferences, and requirements must be disclosed before payment, including through the "Anything else I need to know" section of the commission form.This includes, but is not limited to:specific colors;
fabrics;
embroidery preferences;
accessories;
proportions;
expressions;
hairstyles;
character-specific details;
any other information that may affect the final result.By completing payment, you confirm that all relevant information has been disclosed.Requirements, preferences, or design details omitted from the commission form, or communicated after the commission has been accepted, may be refused and are not my responsibility.4. Design Approval ProcessDepending on the commission type, you will be asked to approve:Face and clothing preview for YCH Nui commissions;
Face preview for YCH Fumo commissions.Three (3) rounds of revisions are included for these previews at no additional charge.Any revision requests beyond these three rounds may incur a fee equal to ten percent (10%) of the total commission price per additional round.Only the preview elements listed above are submitted for approval.All remaining aspects of the plush, including but not limited to hair shape, bangs, proportions, assembly methods, construction details, finishing techniques, and other artistic or technical elements, are created based on the references provided, my artistic judgment, my technical expertise, and my established production methods.By approving the preview(s), you acknowledge and accept that all remaining aspects of the plush will be completed without further approval.Once production has begun, no character changes will be accepted.The finished product will not be submitted for additional approval, and no revisions, remakes, alterations, or adjustments will be provided based on preferences regarding elements that were not included in the approval process.5. Handmade Nature and Artistic DiscretionAll products are handmade.As a result, slight variations, minor asymmetry, visible threads, small glue marks hidden beneath fabric layers, and other minor handmade characteristics may occur. These are not considered defects and are inherent to handcrafted work.I create all commissions using techniques, materials, tools, and construction methods that fall within my personal area of expertise and comfort.I am not obligated to replicate unfamiliar techniques, adopt alternative workflows, or experiment with methods outside my established skill set.By commissioning me, you acknowledge and accept that the final product will reflect my artistic style, technical knowledge, production standards, and interpretation of the provided references.6. Materials and Color AccuracyI will make every reasonable effort to match the colors, fabrics, embroidery, and materials shown in your references.However, colors displayed on screens may differ from physical materials due to monitor settings, screen calibration, photography conditions, and material availability.Certain colors, fabrics, or materials may not exist physically or may not be commercially available.Reasonable substitutions, adaptations, or approximations may therefore be necessary.
My commissions are best suited to clients who are comfortable with these natural variations.7. Embroidery and Design Limitations for YCH NuiDue to the physical limitations of embroidery and the small scale of Nui facial details, certain designs may require simplification or adaptation.Facial embroidery will be adjusted into a chibi-style similar to Banpresto's.I do not offer drastically different embroidery styles outside my established workflow.8. Communication and UpdatesAll interactions must be conducted respectfully and professionally.I reserve the right to refuse service, discontinue communication, cancel a commission, or refuse future orders in cases of harassment, aggression, inappropriate behavior, or repeated disrespect.Progress updates are provided through:the approved preview stage(s);
the public Masterlist.These are the only progress updates provided.Please refer to the Masterlist for real-time order status information.I do not respond to individual progress inquiries beyond the update system described above.9. Response RequirementsYou are responsible for responding to required business inquiries within a reasonable timeframe.Failure to respond for more than one (1) full working month may result in the commission being considered abandoned and cancelled without refund.10. Processing TimeCommissions are generally processed according to their place in the queue. However, multiple commissions may be worked on simultaneously, and progress may not be linear. Orders with lower complexity, fewer technical requirements, or shorter production times may be completed before earlier, more complex commissions.Processing times vary depending on workload, complexity, material availability, health, personal circumstances, and other factors.By commissioning me, you acknowledge that completion times are estimates and not guarantees.11. ShippingAll shipments include tracking and are billed through your invoice.You are responsible for monitoring shipment progress and ensuring that your shipping address is accurate and final before shipment.Additional fees resulting from address corrections, rerouting requests, pickup-point changes, or similar carrier services remain your responsibility.12. Customs Duties and Import TaxesYou are solely responsible for any customs duties, import taxes, VAT, brokerage fees, or other charges imposed by your country.I am not responsible for delays, costs, or issues resulting from customs processing.13. Delivery ResponsibilityOnce a package has been transferred to the shipping carrier, responsibility for physical transportation rests with that carrier.All shipments are insured where applicable.In the event of loss or damage during transit, I will reasonably assist with insurance or carrier claims, but carrier decisions remain outside my control.14. Refunds, Returns, and CancellationsDue to the custom-made nature of commissions, refunds and returns are generally not available once production has begun.Commission cancellations requested after production has started may be refused.If I cancel a commission due to your violation of these Terms, inappropriate conduct, or failure to fulfill your obligations, payments already made are non-refundable and compensate for time, labor, administrative work, and materials already allocated to the commission.15. Intellectual PropertyYou may not claim authorship of my work.Reproduction, resale, mass production, commercial exploitation, or use of my designs for commercial purposes without my explicit written permission is prohibited.All intellectual property rights remain mine unless otherwise agreed in writing.16. Use of ImagesUnless otherwise agreed in writing before payment, I reserve the right to photograph, display, tag, publish, and promote completed commissions for portfolio, social media, masterlist, advertising, and general business purposes.If you wish for your commission to remain private or confidential, you must request this before payment. Confidentiality requests are subject to approval and incur an additional fee of 25% of the total commission price.Once a confidentiality request has been accepted and paid for, I will not publicly display, publish, tag or promote the commissioned item for the agreed confidentiality period.However, I reserve the right to retain photographs, records, and production documentation of the commission for personal archives, insurance purposes, legal compliance, dispute resolution, and business recordkeeping.Confidentiality requests made after payment or after production has begun may be refused.17. Privacy and Data ProtectionPersonal information provided during the commission process will be handled confidentially and used solely for business purposes.In accordance with applicable data protection laws, including GDPR where applicable, you may request access to, correction of, or deletion of your personal information.18. Changes to These TermsI reserve the right to modify these Terms of Service at any time.The version in effect at the time payment is completed will govern the commission unless otherwise required by law.19. Acceptance of TermsBy checking the "I have read and agree to the Terms of Service" box, submitting a commission form, or completing payment, you acknowledge that you have read, understood, and agreed to these Terms of Service in their entirety.
